So, this is how it goes...

I have been listening to Anarcho Punk bands since 1981 and have brought nearly all my records directly from the bands. I used to write on a regular basis to Joy from Crass and got most of the Crass Records and Corpus Christi Records direct. I got my Subhumans records directly from Dick, he even stayed at my house when Citizen Fish tour NZ in 1996!!

I run a blog called "Mad Blasts Of Chaos" where I post a lot of out of print Records and Tapes, mostly very obscure releases, but I am now being threatened by Southern Records for posting material that is currently not available in any format BUT they claim to own the right to!! They have threatened legal action against me. I find this to be an afront to every thing that the Anarcho-Punk movement stood for. I suppose in this day and age profits DO BECOME MORE IMPORTANT THAT IDEALS!!

I am very saddened by the actions of Southern Records and their Corporate approach to what most of us would consider a free and independant scene.

You are incorrect in stating that all of the material is unavailable. Most of the material is currently available in vinyl, CD and download format. That which is not available is either only temporarily out of print, or is not in print by the choice of the artist.

Southern were a bloody pain to deal with when we toured Steve Ignorant and they pissed a lot of people off on every leg of the Last Supper tour. And I think Southern were also the reason Bob the bass player left after the US tour and got replaced by Pete.

In case I get threatend by some legal muppets I won't go into more details but what I'm saying is that I'm pretty sure that none of the bands would be behind this.

To be honest Sean I think you're being a bit of a drama queen over this. It's not like you've had to fork out heaps of money for a lawyer to defend yourself against some corporate juggernaut. Southern have asked you to remove something from your website cos you hadn't asked them or the band if you can distro it. Big deal. All you had to do was ask. I know your intentions were to make available what is a great album that was always hard to get in NZ, but not everyone is gonna see it that way.

The whole issue of free downloads tends to bring out strong opinions. People used to make tapes for themselves or friends, then technology changed and people burned CDs. Now with the internet you can make stuff freely available to whoever has access to download it. Mostly that's cool, but at the end of the day if the material isn't yours then it's usually best to ask first, and in the small world of punk rock that's usually not too hard to do.

Dan from Profane Existence wrote an interesting piece on the subject not too long ago. They had spent a fair bit of money recording a band (can't remember who) and getting it ready for release when someone made a (lesser audio quality) recording of it available as a free download. PE were pissed off cos they were the ones spending the money in the first place to make the recording available. On a similar line, when Code 13 toured Asia/Pacific in 2000 they were relying on sales of their t-shirts to help recover their huge touring costs. They were kinda pissed off when they got to NZ and found that Code 13 t-shirts were being sold at one of the gigs with the money (admittedly not a lot) going into the pocket of someone who had not spent US$11,000 on air tickets. The intentions of the guy were to make t-shirts available for a cheap price which is cool, but it's something that can cut into a bands ability to not lose heaps of money when touring. I think the same can be said of recordings. We all know that there's fuck all money to be made playing punk rock, and cash coming in from sales of records/CDs/downloads/t-shirts can make the difference between a band being able to afford to tour, record or buy new gear. Something to think about, and I'm sure that I'll get some people wank on about 'corporate scum' (who happened to release all those great punk records at a price way cheaper than major labels in the first place!) but I don't give a fuck. Asking the bands first is always a good place to start.
